1. Platform Nature

LeAgo Property Solutions is a digital platform providing property listing, property discovery, service marketplace and Smart Shop functionality.

In relation to property listings, LeAgo is not a real estate agency, estate agent, broker, conveyancer, property seller, landlord or buyer unless expressly stated otherwise for a particular transaction.

LeAgo generally provides the technology and platform through which users can advertise, discover and communicate about properties.

LeAgo does not ordinarily negotiate property transactions, determine property prices, collect property commissions, or act as an intermediary between buyers and sellers.

2. Property Listings

Property listings may be submitted by estate agents, agencies, developers, landlords, property owners or other authorised parties.

The person or organisation submitting a listing remains responsible for the accuracy, legality and completeness of the information supplied.

This includes, where applicable:

• Property ownership or authority to advertise the property
• Price and availability
• Property descriptions
• Images and videos
• Location information
• Property features and specifications
• Contact information
• Any claims concerning finance, approvals, incentives or transaction costs

LeAgo may review, edit, restrict, suspend or remove listings where we believe this is reasonably necessary, including where information appears inaccurate, misleading, unlawful, outdated or inconsistent with platform requirements.

3. Property Transactions

Any sale, rental, lease, reservation, deposit, commission, viewing, negotiation or other property transaction is between the relevant parties.

Users should independently verify the property, listing party, documentation, pricing, ownership, authority to sell or rent, and any other information before entering into a transaction or making payment.

LeAgo does not guarantee that a property will remain available after being listed or that information supplied by a listing party will remain unchanged.

4. Property Enquiries, Leads and Commissions

Property enquiries submitted through LeAgo may be forwarded to the relevant listing party so that the parties can communicate directly.

LeAgo does not claim ownership of legitimate property leads or the resulting transaction.

Unless expressly stated otherwise, commissions, professional fees and other earnings arising from a property transaction remain matters between the relevant parties.

LeAgo does not guarantee that an enquiry will result in a viewing, sale, rental or other transaction.

5. User Accounts

Certain platform features may require registration.

Users are responsible for providing accurate information and for keeping their account credentials secure.

Users should not allow another person to use their account where doing so could compromise the security or integrity of the platform.

LeAgo may suspend or terminate an account where there are reasonable grounds to believe that the account is being used fraudulently, unlawfully, abusively or in breach of these terms.

6. User-Submitted Content

Users may submit property descriptions, photographs, videos, documents, reviews, business information and other material.

By submitting content, you confirm that you have the necessary rights or permission to submit and use that content.

You grant LeAgo permission to display, reproduce, format, resize, adapt and distribute submitted content as reasonably necessary to operate, promote and improve the platform.

You remain responsible for ensuring that submitted content does not infringe another person's copyright, trademark, privacy, personal information or other legal rights.

7. Accuracy of Information

LeAgo aims to provide a useful and reliable platform, but information displayed on the platform may originate from users, suppliers, manufacturers, service providers or other third parties.

Information may change without notice, including prices, stock availability, property availability, specifications, images, delivery estimates and service-provider availability.

Users should confirm important information with the relevant party before making decisions or entering into transactions.

8. No Guarantee of Results

LeAgo does not guarantee a particular number of property views, enquiries, leads, sales, rentals, service requests, product sales or other commercial results.

Results may depend on market conditions, pricing, demand, advertising quality, location, product availability, customer behaviour and other factors outside LeAgo's control.

9. Services Marketplace

LeAgo may provide a platform through which customers can submit service requests and service providers can receive or respond to opportunities.

Unless expressly stated otherwise, LeAgo is not the contractor, installer, technician or service provider performing the requested work.

Service providers remain responsible for their qualifications, pricing, workmanship, licensing, insurance, compliance and agreements with customers.

Customers should independently confirm the provider's qualifications, quotation, scope of work and applicable terms before authorising work.

10. LeAgo Smart Shop

LeAgo Smart Shop allows customers to browse and purchase selected products through the platform.

LeAgo may source products from manufacturers, distributors, wholesalers or other suppliers. Product availability may therefore depend on third-party stock.

Product descriptions, images, specifications and other information are provided for information purposes and may be supplied or influenced by manufacturers or suppliers.

Where an important specification is material to your purchase, we recommend confirming it before placing the order.

11. Prices, Stock and Product Availability

Prices and stock availability may change from time to time.

A product being displayed on the website does not necessarily mean that the product is immediately available for dispatch.

Where a product becomes unavailable after an order is submitted, LeAgo may contact the customer regarding available options, including an alternative product, revised availability or cancellation where applicable.

LeAgo reserves the right to correct obvious pricing, description or technical errors.

12. Orders and Pro Forma Invoices

Adding products to a cart or generating a Pro Forma Invoice does not necessarily mean that an order has been finally accepted or that stock has been reserved.

An order may be subject to stock confirmation, payment confirmation and supplier availability.

Customers should review the product descriptions, quantities, delivery details and total amount shown on the invoice before making payment.

13. Payment

Where payment is made by electronic funds transfer or another payment method supported by LeAgo, the customer is responsible for ensuring that the correct payment reference and amount are used.

Payment confirmation may be required before an order is processed or released for fulfilment.

LeAgo may delay processing where payment cannot be verified or where a payment appears suspicious, incomplete or inconsistent with the order.

14. Delivery

Delivery estimates are estimates and may depend on product availability, supplier processing, courier capacity, destination, public holidays, customs requirements and other circumstances.

Where stated, the usual target delivery period is approximately 7–14 days, subject to availability and the applicable delivery conditions.

Customers are responsible for providing an accurate delivery address and contact details.

Delivery charges, customs duties, taxes, import charges or other destination-related costs may apply depending on the destination and order.

15. Installation and Setup

Unless expressly stated otherwise, product prices do not include installation, configuration, electrical work, plumbing, mounting, network setup or other professional services.

Customers are responsible for ensuring that products are installed and used in accordance with applicable manufacturer instructions and safety requirements.

Certain products may require qualified or licensed professionals for installation.

16. Returns, Refunds and Cancellations

Returns, refunds and cancellations for Smart Shop purchases are governed by the Returns & Refunds Policy .

Nothing in these terms is intended to remove or reduce any consumer right that cannot lawfully be excluded.

Customers should contact LeAgo as soon as reasonably possible where goods arrive damaged, incorrect, incomplete or defective.

17. Product Warranties

Where a manufacturer or supplier provides a warranty, the warranty may be subject to that manufacturer's or supplier's terms and conditions.

LeAgo does not manufacture products merely because they are sold through the Smart Shop and does not automatically become the manufacturer or guarantor of a manufacturer's warranty.

Warranty claims may require assessment, supporting information, photographs, serial numbers, proof of purchase or inspection by the relevant manufacturer, supplier or authorised service centre.

18. Smart, Electronic and Connected Products

Certain products sold through the Smart Shop may depend on electricity, Wi-Fi, Bluetooth, mobile networks, third-party applications, cloud services, subscriptions, manufacturer platforms or compatible devices.

LeAgo cannot guarantee the uninterrupted availability of third-party applications, networks or cloud services that are outside LeAgo's control.

Customers should check compatibility and technical requirements before purchasing where those requirements are important to the intended use.

19. Botswana and Other Cross-Border Orders

LeAgo may make selected products available to customers outside South Africa.

Cross-border orders may be subject to different delivery requirements, customs procedures, import duties, taxes, regulatory requirements and manufacturer warranty territories.

Customers are responsible for complying with applicable laws and requirements in the destination country to the extent that those responsibilities lawfully fall on the customer.

LeAgo does not guarantee that every product, warranty, service, application or feature available in South Africa will operate or be supported in another country.

20. Third-Party Providers and Suppliers

LeAgo may work with third-party manufacturers, distributors, couriers, service providers, payment providers, technology providers and other businesses.

Third-party services may be subject to their own terms and conditions.

LeAgo will take reasonable steps to operate the platform and coordinate relevant services, but cannot control every action, delay, decision or failure of an independent third party.

21. Prohibited Use

Users may not use the platform to:

• Commit or facilitate fraud
• Submit knowingly false or misleading information
• Advertise property or products without the necessary authority
• Harass, threaten or abuse other users
• Attempt to gain unauthorised access to accounts or systems
• Distribute malware or malicious code
• Interfere with the operation of the platform
• Use the platform for unlawful purposes
• Scrape, copy or commercially exploit platform content without permission where such use is not otherwise permitted by law

22. Platform Availability and Changes

LeAgo aims to keep the platform available and functional, but temporary interruptions may occur due to maintenance, hosting, software updates, connectivity problems, security incidents or circumstances outside our reasonable control.

LeAgo may add, remove, modify or discontinue platform features where reasonably necessary to operate or improve the service.

23. Intellectual Property

Unless otherwise indicated, the LeAgo Property Solutions name, branding, website design, software, original graphics, text and other platform materials belong to LeAgo or are used under appropriate permission.

Nothing in these terms grants users ownership of LeAgo's intellectual property.

24. Privacy and Personal Information

LeAgo may collect and process personal information necessary to operate accounts, property enquiries, service requests, purchases, deliveries, communications, security, analytics and related platform functions.

Personal information will be handled in accordance with applicable privacy and data protection requirements and LeAgo's applicable privacy practices.

25. Limitation of Liability

To the maximum extent permitted by applicable law, LeAgo Property Solutions will not be responsible for losses arising from matters outside LeAgo's reasonable control or from transactions, services or representations made directly by independent users, agents, sellers, landlords, service providers, manufacturers, suppliers, couriers or other third parties.

This may include, where legally permitted:

• Property transaction disputes
• Incorrect information supplied by users or third parties
• Supplier or manufacturer delays
• Courier delays or delivery interruptions
• Third-party service failures
• Internet, hosting or telecommunications interruptions
• Losses arising from a user's own decisions or actions
• Indirect or consequential losses where exclusion is permitted by law

Nothing in these terms excludes or limits liability or consumer rights where doing so would be unlawful.

26. User Responsibility and Indemnity

To the extent permitted by law, a user may be responsible for losses, claims, costs or reasonable expenses arising from the user's unlawful conduct, fraud, misuse of the platform, infringement of another person's rights, or breach of these terms.

This section does not apply where such responsibility cannot lawfully be imposed.

27. Complaints and Communication

If you have a concern about the platform, a Smart Shop order, a property listing or another LeAgo service, please contact us so that we can investigate and, where appropriate, assist with resolving the matter.

28. Changes to These Terms

LeAgo may update these Terms & Conditions from time to time to reflect changes to the platform, services, products, legal requirements or business operations.

The latest version published on this page will apply to future use of the platform, subject to applicable law.

29. Applicable Law

These terms are intended to operate subject to the laws applicable to the relevant transaction, user and location.

Where South African law applies, these terms are subject to applicable South African legislation and consumer protections.

Where a transaction takes place in another jurisdiction, mandatory laws and consumer protections applicable to that transaction may also apply.

30. Severability

If any provision of these terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the extent necessary where legally permitted, and the remaining provisions will continue to apply.

31. Entire Terms

These Terms & Conditions, together with any policies specifically referred to on the LeAgo platform, form the general terms governing use of the relevant LeAgo services.

Additional terms may apply to particular products, services, promotions, suppliers, payment methods or transactions.
